Terms of Use

Smylift Dental Clinics Private Limited (hereinafter referred to as “Smylift”, “we”, “our”, “us”) is the author and publisher of the internet resource www.smylift.com (“Website”), along with software applications including but not limited to the mobile application (“App”) (collectively referred to as the “Services”).

The term “Smylift” shall include its partner clinics, affiliates, or associated business entities (“Partners”).

Please read these Terms of Use along with our Privacy Policy available at [link to privacy policy] and any other applicable policies (together referred to as the “Agreement”) carefully before accessing the Website/App or availing any Services.

Your access, browsing, or use of our Website/App, and/or purchase of our Services constitutes your consent to comply with and be bound by this Agreement. If you do not agree, we advise you not to use our Website, App, or Services.

We reserve the right to modify or terminate any portion of this Agreement at any time, at our sole discretion.

A. Applicability of Terms

This Agreement applies to you whether you are:

  • A patient, their attendant, representative, relative, or friend; or
  • A user of the Website or App.

This Agreement applies to all Services provided by Smylift, whether through clinics, Website, or App. Services may evolve over time, and this Agreement will continue to apply to your interactions with Smylift, both online and offline.

You must be 18 years of age or older to use our Website/App or Services. By using our Services, you represent and warrant that you are legally competent to do so.

B. Services
  • “Services” means dental healthcare services provided by Smylift Dental and its partner clinics.
  • “Products” means dental products, appliances, and materials manufactured or sourced by Smylift and used in treatments.
C. Booking & Appointment

While Smylift strives to honor confirmed appointment requests, it does not guarantee that all appointments will be fulfilled as scheduled. Appointments may be subject to rescheduling or cancellation based on clinic availability, doctor availability, or unforeseen circumstances.

Smylift shall not be liable for any inconvenience or damages caused due to cancellation or rescheduling of appointments.

D. Online Payments

Smylift enables secure online payments via third-party payment gateways. All such transactions will be governed by the terms, conditions, and privacy policies of the respective payment processors. Smylift shall not be responsible for failed transactions, declines, or technical issues beyond its control.

E. Refund Policy

Refunds may be issued in cases such as:

  • Erroneous payment into Smylift’s account.
  • Appointment cancellation by the patient at least 24 hours prior to the scheduled time.
  • Change in patient’s medical condition making treatment unsuitable (with documented medical proof).

Refunds are subject to deductions for treatments already initiated, diagnostics performed, consumables used, and fabrication costs for appliances/crowns/aligners.

Refund timelines: 30-45 working days from receipt of a valid request.

Refund will be provided via:

  1. Bank transfer to patient’s account, or
  2. Smylift Credit Cover – Refund amount credited to patient’s Smylift wallet for future treatments (valid for 1 year and transferable to family/friends).

No refund shall be applicable if:

  • Treatment has commenced or is partially completed.
  • Aligners, crowns, implants, or appliances have been ordered or fitted.
  • Patient fails to attend appointments, comply with instructions, or delays treatment.
  • More than 6 months have passed since treatment completion.

Mandatory deductions apply:

  • Cancellation of Aligners: ₹10,000
  • Cancellation of Implants/Orthodontics: ₹5,000
  • Cancellation of other treatments: ₹3,000

F. Re-treatment Policy

Smylift is committed to best clinical practices. However, outcomes may vary due to patient biology, compliance, and other factors beyond clinical control.

Re-treatment may be offered (within 6 months of original treatment) if:

  • Filling, appliance, or crown fails.
    Treatment outcome is unsatisfactory despite compliance.
  • Implant or orthodontic work requires adjustment.

Eligibility requires strict compliance with follow-up visits and care instructions.

G. Termination Rights

Smylift reserves the right to suspend or terminate a patient’s access to Services if:

  • Terms of this Agreement are breached.
  • Fraudulent or abusive activities are suspected.
  • Defamatory actions are taken against Smylift or its doctors.

H. Disclaimer of Liability

All content on the Website/App is provided “as is” without warranty. Dental outcomes depend on multiple factors including patient compliance, health conditions, and biological response. Smylift does not guarantee exact results.

I. Limitation of Liability

Smylift shall not be liable for:

  • Delays, cancellations, or unavailability of Services.
  • Technical errors, system downtime, or force majeure events.
  • Indirect, incidental, or consequential damages.

J. Indemnification

You agree to indemnify and hold Smylift, its affiliates, directors, and staff harmless against any claims, liabilities, or damages arising from your use of Services, breach of this Agreement, or violation of third-party rights.

K. Governing Law & Jurisdiction

This Agreement shall be governed by the laws of India. Disputes shall be subject to the exclusive jurisdiction of courts in Mumbai, Maharashtra.
